TERMS & CONDITIONS

Terms & Conditions

Cardholder Agreement — Fees, Credit Terms & Card Use. Effective Date & Last Updated: September 15, 2026.

By activating or using a My Island Visa card or wallet, you agree to be bound by these Terms & Conditions, including the fee schedule and credit-terms disclosures below.

1. Acceptance of Terms

These Terms & Conditions (“Terms”) form a binding agreement between you (“Cardholder,” “you,” or “your”) and Azany Group LLC (“Azany Group,” “we,” “us,” or “our”), operator of My Island Visa (“MIV” or the “Card”). By applying for, activating, loading, or using a My Island Visa card or the My Island Visa mobile wallet (collectively, the “Services”), you accept and agree to be bound by these Terms, our Privacy Policy, and any product-specific disclosures provided at activation.

These Terms govern the My Island Visa card program globally, including cards issued through Caribbean market partners and any diaspora activation channel. If you do not agree to these Terms, do not activate or use the Card.

2. Definitions

  • “Account” means the My Island Visa wallet account associated with your Card, including all linked currency balances.
  • “Card” means any physical or virtual My Island Visa-branded prepaid or stored-value card issued to you.
  • “Issuing Partner” means the licensed bank, card program manager, or card network partner that issues the Card on our behalf.
  • “Available Balance” means the funds loaded to your Account, in each supported currency, available for spending after pending holds.
  • “MIV-to-MIV Transfer” means a transfer of funds between two My Island Visa accounts within the MIV network.
  • “FX Margin” means the foreign-exchange spread applied when your Account converts between currencies.

3. Eligibility & Account Opening

To open a My Island Visa Account, you must be at least the minimum age required to hold a financial account in your jurisdiction (generally 18), provide accurate identity and contact information, and complete identity verification (KYC) as required by our Issuing Partner and applicable law. We and our Issuing Partner reserve the right to decline any application, request additional documentation, or place limits on an Account pending verification, sanctions screening, or fraud review.

4. Card Issuance, Activation & Card Types

My Island Visa offers physical and virtual cards, activated through the MIV app or approved market partners. A Card must be activated before use. Card types, features, currencies supported, and fees may vary by Card type and market, as disclosed to you at activation.

5. Nature of the Card & Credit Terms Disclosure

The My Island Visa Card is a prepaid, stored-value multi-currency card and digital wallet. It is not a credit card, and using the Card does not create a line of credit, a loan, or a revolving credit account.

You may only spend, transfer, or withdraw funds that you have loaded to your Account and that are available as your Available Balance. My Island Visa does not charge interest or a finance charge on your Card balance, because no credit is extended.

The disclosures below are provided in a fees-and-terms format consistent with standard credit- and payment-card disclosure practice, so that you can review all costs of using the Card in one place — even though the Card itself is a prepaid product rather than a revolving credit line.

5.1 If a Credit or Overdraft Feature Is Offered

Where Azany Group or an Issuing Partner separately offers you an optional credit line, overdraft protection, or “buy now, pay later” feature linked to your My Island Visa Account, that feature is governed by a separate credit agreement provided to you at enrollment, which will disclose the Annual Percentage Rate (APR), minimum payment terms, billing cycle, grace period (if any), default interest rate, and credit-reporting practices applicable to that feature. No such credit feature applies to your Account unless you have separately enrolled in it and received that disclosure.

6. Fee Schedule & Pricing Summary

The table below summarizes the categories of fees that may apply to your My Island Visa Account. Specific rates and amounts vary by market, Card type, and currency corridor, and are disclosed in full — in the MIV app and at activation — before you confirm any fee-bearing transaction.

Rates and amounts intentionally are not fixed numerically in this template — the finalized MIV fee schedule (issuance fee, FX margin percentage, remittance-corridor pricing, ATM fee, replacement fee, and dormancy fee) is disclosed in-app, consistent with the pricing our Issuing Partner has approved for each Caribbean market.

We will provide advance notice of any material fee change as described in Section 17.

7. Loading Funds, Balances & Currency Conversion

You may load funds to your Account via the payment methods supported in your market (linked bank transfer, debit card, cash-load partner, or other method disclosed in-app). Your Account may hold balances in multiple currencies. When a transaction, transfer, or withdrawal requires converting between currencies, we apply the FX Margin disclosed in Section 6, calculated against the reference exchange rate available to us at the time of conversion.

8. Using Your Card, Transfers & Limits

You may use the Card to make purchases, withdraw cash where supported, and send transfers, including MIV-to-MIV transfers, subject to available balance and any transaction, daily, or monthly limits disclosed in the MIV app. We and our Issuing Partner may adjust limits based on your verification level, market, or risk profile, and may decline a transaction that exceeds your limit, that we reasonably believe to be fraudulent, or that is directed to a sanctioned or prohibited destination.

9. Promotions & Loyalty Features

We may, from time to time, offer seasonal promotions, cultural-occasion campaigns, or a loyalty and rewards feature linked to your Account. Where such a feature is offered, its specific terms — including accrual, redemption, expiration, and eligibility — will be made available separately at the time of enrollment. We may modify or discontinue any promotional or loyalty feature at any time, subject to the notice provisions in Section 17 and honoring benefits already earned as of the effective date of any change, except where prohibited by law.

10. Cardholder Responsibilities & Prohibited Uses

You agree to:

  • Provide accurate information and promptly update your Account if your details change.
  • Keep your login credentials, PIN, and Card details secure and confidential.
  • Use the Card only for lawful purposes and in accordance with these Terms.
  • Notify us immediately of any suspected unauthorized use, loss, or theft of your Card.

You agree not to use the Card or Services for:

  • Any illegal purpose, including money laundering, terrorist financing, or sanctions evasion.
  • Transactions with merchants or individuals in jurisdictions subject to comprehensive sanctions.
  • Fraud, identity misrepresentation, or attempts to circumvent verification or transaction limits.
  • Any activity that violates the rights of Azany Group, our Issuing Partner, or any third party.

11. Unauthorized Transactions & Liability

If you notice an unauthorized transaction or suspect your Card or Account has been compromised, notify us immediately using the contact details in Section 19. We will investigate promptly. Subject to applicable law and the specific terms of your market, your liability for confirmed unauthorized transactions reported promptly is limited as disclosed in your Card’s market-specific disclosure; you may be responsible for losses resulting from your own gross negligence, fraud, or failure to safeguard your credentials.

12. Card Suspension, Loss, Theft & Replacement

We may suspend, freeze, or terminate your Card or Account at any time if we reasonably suspect fraud, a violation of these Terms, a legal or regulatory requirement, or a risk to you, us, or our Issuing Partner. If your Card is lost or stolen, report it immediately through the MIV app or customer support; we will block the Card and may issue a replacement subject to the fee disclosed in Section 6 (waived for confirmed fraud).

13. Dormancy, Expiration & Account Closure

An Account with no Cardholder-initiated activity for the period disclosed in-app may be classified as dormant and subject to the dormancy fee in Section 6, subject to any legal limits on dormancy fees in your jurisdiction. You may close your Account at any time by contacting support; we will return any remaining Available Balance to you, less any outstanding fees, through a supported payout method, subject to completion of any pending compliance review.

14. Disclaimers & Limitation of Liability

The Services are provided “as is” and “as available.” To the maximum extent permitted by applicable law, Azany Group and our Issuing Partners disclaim all warranties, express or implied, regarding the Services. Neither Azany Group nor our Issuing Partners will be liable for indirect, incidental, special, or consequential damages arising from your use of the Services, except where such limitation is prohibited by applicable law, including consumer-protection law that grants you non-waivable rights.

15. Dispute Resolution & Arbitration

We encourage you to contact customer support first to resolve any issue. Where permitted by applicable law, any dispute arising from these Terms or the Services that cannot be resolved informally will be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small-claims court where eligible. Class actions and jury trials are waived to the fullest extent permitted by applicable law. This arbitration provision does not apply where prohibited by mandatory consumer-protection law in your jurisdiction, including certain Caribbean, EEA, UK, and other markets that guarantee access to courts or ombudsman/financial-services-commission schemes for consumer financial disputes.

16. International Use & Regional Terms

Because MIV operates across Caribbean markets and diaspora communities in North America, the United Kingdom, and Europe, your Card and Account are subject to the laws and regulatory requirements of the market in which your Account was opened, in addition to these Terms. Where local law imposes additional or different requirements — including consumer-protection disclosures, cooling-off rights, complaint-handling procedures, or interest/fee caps under the laws of CARICOM member states or other applicable jurisdictions — those local requirements govern to the extent they conflict with a provision of these Terms in that market. Cross-border transfers are also subject to the destination country’s receiving-side regulations and any associated delays or documentation requirements.

17. Amendments to These Terms

We may amend these Terms from time to time to reflect changes in our Services, pricing, or legal and regulatory requirements. We will provide advance notice of material changes through the MIV app, email, or other reasonable means, and will identify the updated “Last Updated” date. Continued use of the Services after a change takes effect constitutes acceptance, except where applicable law requires your affirmative consent to a specific change (such as a material fee increase).

18. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, and applicable U.S. federal law, without regard to conflict-of-laws principles, except where mandatory local consumer-protection or financial-services law in your market applies notwithstanding this choice of law, as described in Section 16.
